Terms & Conditions
Preamble. These General Terms and Conditions of Sale (the "Terms") govern the entire contractual relationship between the company EBOOKIFY LLC, represented by Charlotte Maison (the "Seller"), and any natural or legal person purchasing a product on the website EBOOKIFY (the "Customer").
1. Definitions
"Website" means the website EBOOKIFY. "Product" means any digital content (e-book, guide, course, bundle) offered for sale. "Order" means the act by which the Customer confirms the purchase of one or more Products. "Download" means the electronic delivery of the files after payment.
2. Purpose and scope
These Terms define the conditions under which the Seller supplies the ordered Products to the Customer. They apply, without restriction or reservation, to any Order placed on the Website. By ticking the acceptance box when placing an Order, the Customer acknowledges having read and accepted these Terms without reservation.
3. Products
The Products offered are exclusively digital content delivered electronically. No physical medium is shipped. Each product page describes the contents, format and available download language (French or English). The Seller reserves the right to modify or remove a Product from the catalog at any time.
4. Prices and currencies
Prices are shown in the currency chosen by the Customer among the proposed currencies (EUR, GBP or USD) and are inclusive of all taxes. The amount charged is the price displayed at the time the Order is confirmed. The Seller reserves the right to change its prices at any time, Products being invoiced on the basis of the rates in force at the time of the Order.
5. Order
The Order is placed online on the Website. It is confirmed by a summary email sent to the address provided by the Customer. The Customer is solely responsible for the accuracy of the information provided. Any Order is deemed firm and final upon validation.
6. Payment
Payment is made online by card via our payment provider Stripe, certified PCI-DSS. The Seller never sees, stores or processes the Customer's banking data. An Order is only deemed accepted upon confirmation of payment by the provider.
7. Delivery
Upon payment confirmation, the Products are immediately made available for download on the confirmation page, and an email containing the download link is sent to the Customer. The files remain accessible indefinitely from the Customer's "My purchases" area, including any future updates.
8. Right of withdrawal
In accordance with applicable law, the right of withdrawal does not apply to digital content supplied immediately once downloading has begun. By validating the Order, the Customer expressly acknowledges and accepts the waiver of this right in order to benefit from immediate delivery.
9. Warranty and refunds
The Seller offers a 30-day "money-back" guarantee. The conditions, exceptions and refund procedures are detailed in the Refund Policy.
10. Liability
The Products are provided for informational and educational purposes. The results obtained vary from person to person and do not constitute a promise of outcome. The Seller's liability is strictly limited to the amount actually paid for the Product concerned and excludes any indirect damages, loss of data or loss of profit.
11. Intellectual property
All content on the Website and in the Products (texts, graphics, illustrations, trademarks, logos) is protected by copyright and remains the exclusive property of the Seller or its licensors. Any reproduction, distribution, adaptation or resale, even partial, without prior written authorization is strictly prohibited and may lead to legal action.
12. Personal data
The Customer's personal data is processed in accordance with the Privacy Policy and applicable law, in particular the General Data Protection Regulation (GDPR).
13. Force majeure
The Seller shall not be held liable for any delay or failure resulting from a force majeure event, as defined by case law, including in the event of outage, interruption of telecommunications services, fire or natural disaster.
14. Severability
If any provision of these Terms is declared null or unenforceable, the remaining provisions shall retain their full force and effect.
15. Changes to these Terms
The Seller reserves the right to modify these Terms at any time. The Terms applicable to an Order are those in force on the day the Order is validated.
16. Governing law and dispute resolution
These Terms are governed by the law of the country where the Seller is established. In the event of a dispute, the Customer agrees to seek an amicable solution with the Seller before any legal action. Failing agreement, the dispute will be brought before the competent courts.
17. Contact
For any question regarding these Terms or an Order, the Customer may contact the Seller at contact@ebookify.club.
